THE PLACING OF A BID SHALL CONSTITUTE ACCEPTANCE OF THE FOLLOWING TERMS OF SALE.
BIDDING: All bidding is per lot as described in this catalogue, and the highest bidder shall prevail at one increment over the next highest bidder. Ties will be broken in favour of the first bid received. Brigham Auctions Ltd reserves the right to withdraw any lot prior to sale, to divide a lot, or to group two or more lots. The auctioneer regulates the bidding and reserves the right to reject any bid, re-offer any lot or to settle any dispute arising from any disagreement on the floor, and the auctioneer’s decision will be final and binding on all parties. A buyer’s premium of 15% on the hammer price will be payable by the purchaser.
PAYMENT: Successful bidders must pick up their lots or arrange for delivery immediately after the sale and payment is due upon receipt. Customers known to us or who have established credit arrangements may have their lots forwarded for payment. Others will receive an invoice and must make payment before lots are sent. We conduct our sales in CANADIAN DOLLARS. U.S. FUNDS are acceptable at the equivalent amount shown on your invoice. Visa, Discover, MasterCard or PayPal will be accepted with a surcharge of 3.5% of the hammer price and the buyer’s premium and Interac will be accepted with a surcharge of 2%. Both charges will be on the hammer price and the buyer’s premium. Please include the information on your bid sheet. Payment for lots, including those on which opinions are desired, shall be made as follows – A successful mail bidder will be notified of lots purchased and must remit before the lots are sent. Delivery will be to the address on the bid sheet. Proof by receipt of sending at the advised address shall constitute delivery. Postage and insurance are payable by the buyer. Title and ownership shall not pass to the buyer until Brigham Auctions Ltd has received full payment. Buyers agree to pay for lots as specified above and no credit is extended. A late payment charge of 2% per month is added to overdue payments, minimum $5.00.
AUTHENTICITY, EXTENSIONS and EXPERTIZATION: In our opinion, all lots are genuine and as described. If a bidder wishes to obtain another opinion from a mutually acceptable expertising authority, they must request an extension in writing before the auction (on the bid sheet is acceptable). Lots must be submitted without delay by the buyer and lots sold under this condition shall be held open for up to 120 days, after which the lot will not be returnable for any reason. Items which already have certificates are sold on the basis of those certificates. Buyers wanting a different certificate must make this request before bidding on the lot. Expenses for certificates shall be borne by the purchaser. If a negative opinion is received within the 120 days, the purchase price will be refunded in full as well as the shipping, taxes and expertising fee to a maximum of $100 CAD. We are not responsible for expenses incurred for the return of any lot. All lots placed on ex- tension must be paid for under our normal terms. Claims for errors in description, including condition, must be made within 7 days after receipt, but no later than 45 days after the auction. Stamps returned must be in the state received and must be sent by registered mail or bonded courier. Lots which have been back stamped by the owner, marked or encapsulated by experts or expert committees are not return- able.
QUALITY: Any lot found to be incorrectly described is returnable within forty-five days from the date of the auction. All disputed lots must be returned intact in the condition received. Any item described in the catalogue as having defects is not returnable on account of its condition and no lot may be returned by bidders who have had an opportunity to examine them, or have had an agent view them on their behalf before the sale. Stamps which have been photographed may not be returned on account of perforations, centering, margins or cancellations. Items photographed in colour are reproduced with extreme care as to accuracy of colour and shade, however they may not be returned be- cause of shade differences between the lot and photograph. Lots described “as is” or having faults are not returnable for any reason. Lots are graded as superb, extremely fine, very fine, fine to very fine, fine, very good, and good. In the case of sets, large blocks, sheets, etc., the condition quoted represents the average condition.
SHIPPING: Shipping and handling will be charged to the the buyer. All shipments will be sent by Registered mail or other secured signature service, and will be covered by our insurance policy whilst in transit.
TAXES: Canadian residents will be charged GST or HST as appropriate for their mailing address and lots picked up or delivered in Ontario will be charged H.S.T.
